Dot Net Ltd Acceptable use Policy, Terms and Conditions of Service.
Our terms and conditions of service were written in order to define what is acceptable regarding the usage of our servers. These guidelines were introduced in order to protect our clients who utilise our online services.These terms and conditions are subject to New Zealand law.
Web Content (Hosted on or from your account.)
Adult and pornographic content is not permitted on our servers. IRC and IRC bots are not allowed to run on our servers. IRCD is not permitted. Hacker programs & archives, Warez, Pirated software are not permitted. Hate sites and distasteful content are not permitted. Content or links to any illegal activity or content, hosted on or off our servers. Content must not consume more than 8Mb of memory space, more than 30 CPU seconds, or use more than 5% of all available system resources at any time. We reserve the right to suspend any service without warning or compensation in the event of non compliance with these limits. FTP Download only sites are not permitted. Banned Scripts / Software The following scripts, services and software are not permitted on our servers. Both Unix and Windows based scripts.

Any site found to be using any of the above will be suspended immediately, without warning. Web content, html pages and contents should consume 80% of your total disk space allocation.
E-mail - sending unsolicited e-mail (SPAM).
Spamming or the sending of unsolicited e-mail is not permitted. Zero tolerance is applied to spammers. Spamming to or from our servers will lead to instant account suspension without prior warning and without compensation of any kind being credited or paid to the account payee.
Refusal of service
We reserve the right to refuse, cancel or suspend service without notice, at our sole discretion. Our decision will be final.
Domain Registration Terms and Conditions
Domain name registration services where carried out by Dot Net Ltd. We cannot be held responsible for any infringements against registered trademarks and further to this, the registrant of any such Domain name infringement will indemnify Dot Net Ltd against any responsibility for such infringements of trademark. By registering a domain name using our service the registrant agrees with all of our terms and conditions as stated within our 'AUP - Terms and conditions of service'.
Domain name registration fees are Non-refundable in any circumstances, once we have processed a Domain name, it is irreversible.
In addition to these terms of registration, all domain name registrants are bound by the policies, terms and conditions implemented by ICANN and the .nz Domain registry (Domainz). These policies, terms and conditions can be found here:- http://www.icann.org and http://www.domainz.net.nz
Compensation - Data storage - Backup - Service
We carry out a minimum of weekly backups of server data, this data is then copied and transferred to another server or hard drive. This does not mean that we are responsible for the safe storage of our clients data, we carry out this service as a good working practice.
In the unlikely event of data or service loss, no compensation will be payable by Dot Net Ltd or any persons connected with Dot Net Ltd for any loss of service, data, earnings or other losses, due to any hardware failure or loss of service from our server. It is the clients responsibility to ensure that all of their data stored on our servers, is backed up to a local or other machine by themselves. Tools are provided within our control panels. This includes and is not limited to, all aspects of our services.
Dot Net Ltd cannot be held responsible for outages or faults in any system that is not directly under our control and any part of any system other than the Host accounts server network connection to the router within the data centre.
Faults should be reported to support.
Data Overage
Shared Hosting clients have no set bandwidth limitations, however we do reserve the right to relocate an extremely busy website to one of our servers located within the USA, should traffic levels become very excessive and the client does not want to pay the extra bandwidth costs associated with hosting an extremely busy website within New Zealand.
We currently charge NZ$15.00 + GST per GB (1GB = 1024 MB) for data transfer above the limits set for each account. We will inform any site that that is nearing their maximum transfer limit and allow them to either suspend service or allow the overage and incur the extra fee for the data transferred.
Data limits have been applied to our hosting accounts in order to protect the abuse of resources. We offer ample data transfer for busy websites and our limits should not impose any limitations upon normal to moderately high traffic hosting accounts that are hosted in our data centre. We simply have to protect ourselves from an abuse of resources.
Uptime Guarantee
If Our guarantee of 99.5% uptime is not met, then we will refund in full the amount paid for the said months service (Excluding any Domain registration fee, which is non-refundable). Data transfer incurred is excluded from this guarantee period and would be charged at $15.00 per GB or part of. Scheduled maintenance falls outside of our uptime guarantee and will be advised in advance, providing our clients have provided us with a contact email address via their control panel or requested insertion into our mailing list.
Cancellation of accounts
Cancellations of accounts should be directed to accounts@dotnetltd.co.nz, 1 Months notice is required before cancelling your hosting account.
Overdue Accounts
Accounts that fall overdue by 7 days will automatically be suspended until we receive payment. If we do not receive payment after a further 7 days, the account will be cancelled. We will make all reasonable attempts to notify the account holder prior to suspending services. A $30.00 re conection fee is required after the account is cancelled.
Clients
Failure to follow any term or condition listed above will provide Dot Net Ltd grounds for the immediate account deactivation of the offending account holders site, further, without refund of any payment made to Dot Net Ltd regarding any of our Hosting or Account services, being made to the deactivated sites account payee. We will also report abuse of any kind to the relative authority and seek legal action if required.
These Acceptable Use and Terms and Conditions of Service are subject to change, it is the responsibility of the Account holder or registrant of our services to read and accept these conditions, before using any of our services. By obtaining our services, the client is stating that they agree with all of our AUP - Terms & Conditions of service and understands them fully. This AUP - Terms and conditions of service applies to all clients at all times - the most recent published information here applies to all clients - existing and new. If you do not agree with any term and condition contained within this document, you are not authorised to sign up for our services.
